What will the other insurance company do?

​It can be hard to predict exactly what the other insurance company will do.  They may do nothing at all, which is just fine.  (Just make sure you don’t miss any limitation periods!)

They may contact you and try to get information from you about how badly you have been injured.  There are many reasons they may want that information. 
  • They may want to set aside an appropriate amount of money to pay you a settlement amount later, and want to get a sense of how much they should set aside. 
  • They may want to send you a settlement cheque right away.  Be careful about accepting.  Once you have agreed to a settlement, you can NOT ask for more if your injuries worsen later.
  • They may want to know if your injuries might be minor injuries.  They are allowed to compel you to go to a medical examination with a doctor who could make a declaration that you have a minor injury.  An early opinion from a doctor that you have a minor injury can be difficult to deal with if your injuries later become a serious impairment.

Should you talk to the other insurance company?

It depends.  It depends on your situation and the particular facts of your accident and injuries.  Remember that the other insurance company has no real reason to consider your best interests. Remember, as well, that the insurance company knows this process inside and out, while you have probably never made an injury claim before.
